Terms of service
General Terms and Conditions (GTC)
MaquiBeef – Argentine Black Angus Beef
MaquiBeef e.U. · Version: July 2026
This English version is provided for convenience only. In the event of any discrepancy, the German version is legally binding.
1. Scope and provider
(1) These General Terms and Conditions (GTC) apply to orders placed by consumers and businesses via the MaquiBeef online shop and, where agreed in individual cases, to other purchase, delivery and pickup transactions with MaquiBeef.
(2) The provider and contractual partner is:
MaquiBeef e.U.
Owner: Maximiliano Fernando Schultz
Am Modenapark 10/19, 1030 Vienna, Austria
Email: office@maquibeef.at
Company register no.: 682667y
Register court: Commercial Court of Vienna
VAT ID: ATU83457769
(3) Consumers and businesses are distinguished in accordance with § 1 KSchG (Austrian Consumer Protection Act). Where individual provisions apply exclusively to businesses, this is expressly stated.
(4) Deviating terms and conditions of a business only apply if MaquiBeef has expressly agreed to their inclusion. Mandatory statutory rights of consumers remain unaffected.
2. Subject matter of the contract
(1) MaquiBeef sells in particular beef as well as other foods and own-brand products. The type, scope and characteristics of the subject matter of the contract are determined by the respective product description and the product properties stated in the ordering process.
(2) With natural products, shape, marbling, size and weight may deviate slightly for natural or production-related reasons, provided that the agreed characteristics and usability of the product are not significantly impaired. For products whose weight is stated as approximate (“approx.”), corresponding natural or production-related weight deviations are possible. The sales price, any unit price to be stated and the information relevant for weight-based price calculation are shown with the respective product or in the ordering process.
(3) Where subscriptions, event boxes or special orders are offered, the provisions set out in the respective offer and in these GTC apply additionally.
3. Conclusion of the contract
(1) For orders via the online shop: the presentation of products in the online shop does not constitute a binding offer by MaquiBeef to conclude a contract, but an invitation to the customer to place an order.
(2) By clicking the order button, the customer submits a binding offer to purchase the goods in the shopping cart. In accordance with § 8 FAGG, the order button is clearly labelled with the words “order with obligation to pay” or an equally unambiguous wording indicating that the order entails an obligation to pay.
(3) MaquiBeef confirms receipt of the order by email without delay. The confirmation of receipt does not yet constitute acceptance of the offer unless acceptance is expressly declared therein.
(4) For orders via the online shop, the contract is concluded by express acceptance of the offer by MaquiBeef or by shipping or making available the ordered goods.
(5) For orders outside the online shop, the contract is concluded by offer and acceptance in accordance with the general statutory provisions.
(6) The language of the contract is German.
4. Prices and payment terms
(1) All prices are stated in euros. For consumers, prices include statutory VAT. Any additional delivery or shipping costs are shown before the order is placed. For businesses, prices may be agreed net plus statutory VAT.
(2) The payment methods offered in the respective ordering process are available. Where payment service providers are used, their terms may additionally apply, provided they are validly incorporated into the respective payment service relationship.
(3) The purchase price is due upon conclusion of the contract unless otherwise agreed for the chosen payment method. For subscriptions, payment is collected before the next scheduled delivery in accordance with section 10.
(4) If a consumer is in default of payment, the statutory default interest pursuant to § 1000 ABGB applies. In addition, the collection and recovery costs recoverable pursuant to § 1333 (2) ABGB must be reimbursed.
(5) For businesses in default of payment, the statutory default interest pursuant to § 456 UGB applies. In addition, MaquiBeef may claim the lump sum pursuant to § 458 UGB as well as further collection costs recoverable under the statutory provisions.
5. Delivery, shipping, pickup and cold chain
(1) The delivery area is currently Vienna; an extension to all of Austria (Austria-wide express shipping in special cooling boxes) is planned and will be announced in the shop in good time once this offer is available. Same-day delivery within Vienna is offered on up to four fixed weekdays with a defined time window; the applicable time window is communicated in the ordering process and in the shipping confirmation. Same-day delivery is only possible if the order is received within the order deadline stated in the shop. Delivery in Vienna is currently carried out by MaquiBeef itself; once Austria-wide shipping is available, it will be carried out by a commissioned logistics company.
(2) Once Austria-wide shipping is available, deliveries outside Vienna will be made as express shipments in special insulated cooling boxes with ice packs to ensure the necessary cooling until delivery. Delivery is carried out by a logistics company commissioned by MaquiBeef.
(3) The customer is obliged to choose the delivery address so that acceptance of the shipment on the stated delivery day is likely (e.g. home or work address), to open the shipment immediately after delivery and to refrigerate or freeze the chilled goods without delay. MaquiBeef expressly points out that delayed removal from the cooling box may impair the shelf life and quality of the goods.
(4) If delivery is not possible despite a reasonable delivery attempt for reasons for which the customer is responsible (e.g. customer not reachable, incorrect delivery address), MaquiBeef is not liable for any resulting deterioration in the quality of the goods, provided that MaquiBeef and the commissioned logistics company have exercised reasonable care. This does not apply if MaquiBeef is at fault. For consumers, the mandatory statutory provisions on the transfer of risk and other mandatory consumer rights remain unaffected.
(5) Delivery dates are estimated dates unless expressly designated as binding. If a binding date has been agreed and MaquiBeef culpably exceeds it, the customer is entitled to the statutory rights.
(6) Shipping costs are shown before the order is completed. MaquiBeef reserves the right to offer free delivery above a minimum order value stated in the shop.
(7) Products offered in the shop can generally be ordered from stock already stored and available in Vienna; as a rule, an order does not require subsequent import from abroad. For larger order quantities, special batches or B2B bulk orders (see section 15) requiring separate procurement or import delivery, the expected delivery date is agreed individually with the customer; in this case, section 6 (Force majeure and supply chain disruptions) also applies.
6. Force majeure and exceptional delivery obstacles
(1) MaquiBeef is released from the obligation to deliver on time or is entitled to a corresponding extension of the delivery period if non-compliance is due to circumstances that MaquiBeef cannot influence despite reasonable care (force majeure). This includes in particular natural events, strikes, lockouts, official measures, pandemics, cyberattacks on shop or logistics systems, failures of the cold store, in particular as a result of a power outage, and the failure of commissioned logistics or delivery service providers, if and to the extent that the respective event cannot be avoided or overcome by MaquiBeef despite reasonable care.
(2) For larger orders, individual special batches or B2B orders requiring separate procurement from Argentina (see section 5 (7)), paragraph 1 applies accordingly to delays or failures within the international supply chain, in particular at slaughterhouses or frigoríficos, in sea or air freight, in customs clearance, with export licences or other permits related to import, if and to the extent that the respective delay or failure is beyond the control of MaquiBeef and cannot be avoided or overcome by MaquiBeef despite reasonable care.
(3) MaquiBeef will inform the customer without delay of the occurrence of a force majeure event and, where possible, of the expected duration of the resulting delay. If the obstacle to performance lasts longer than four weeks, both MaquiBeef and the customer are entitled to withdraw from the contract with regard to the delivery affected. Payments already made for the affected delivery will be refunded without delay in this case.
(4) Mandatory statutory rights of the customer, in particular statutory warranty, damages and withdrawal rights as well as mandatory consumer rights, remain unaffected by this provision. Any statutory right of withdrawal to which the consumer is entitled in the respective case also remains unaffected.
7. Retention of title
(1) Goods delivered by MaquiBeef remain the property of MaquiBeef until the purchase price under the respective purchase contract has been paid in full.
(2) As long as the retention of title exists, the customer must inform MaquiBeef without delay of seizures or other third-party access to the goods subject to retention of title, insofar as this is necessary to protect the rights of MaquiBeef.
(3) For businesses, resale of the goods subject to retention of title in the ordinary course of business is permitted. Permission to resell does not affect MaquiBeef's purchase price claims against the business.
(4) Further security agreements with businesses, in particular the assignment of claims arising from the resale of goods subject to retention of title, require a separate agreement.
8. Right of withdrawal for consumers
(1) For contracts subject to the Austrian Distance and Off-Premises Contracts Act (FAGG), consumers generally have a statutory right of withdrawal in accordance with §§ 11 et seq. FAGG. For purchase contracts for goods, the withdrawal period is generally 14 days from the day on which the consumer or a third party designated by them, other than the carrier, has taken possession of the goods.
(2) The right of withdrawal does not exist where a statutory exclusion applies. This applies in particular to goods that are liable to deteriorate rapidly or whose expiry date would be exceeded quickly (§ 18 (1) no. 4 FAGG), provided that the statutory requirements are met for the respective product.
(3) The consumer may exercise the right of withdrawal within the statutory period by means of a clear declaration to MaquiBeef, in particular by email to legal@maquibeef.at. Sending the declaration of withdrawal in good time is sufficient to meet the deadline.
(4) In the event of an effective withdrawal, the statutory provisions apply to the refund, the return of the goods, the return costs and any loss in value. MaquiBeef informs the consumer before conclusion of the contract, in accordance with the statutory requirements, about the existence or non-existence of the right of withdrawal and its conditions, time limits and exercise.
(5) Businesses are not entitled to the statutory right of withdrawal provided for consumers under the FAGG.
(6) For products for which no statutory exclusion applies pursuant to section 8 (2) (in particular non-perishable goods), the following model withdrawal information and model withdrawal form apply additionally.
(7) Independently of the statutory right of withdrawal, MaquiBeef voluntarily grants new customers a 100% Enjoyment Guarantee on the first kilo ordered in their first order. The conditions of this guarantee are described in our “Refund policy”. Statutory warranty rights remain unaffected.
Model withdrawal information
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party designated by you, other than the carrier, have taken possession of the goods.
To exercise your right of withdrawal, you must inform us (MaquiBeef e.U., Am Modenapark 10/19, 1030 Vienna, Austria, email: legal@maquibeef.at) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

9. Warranty, defects and complaints
(1) For consumers, the mandatory statutory warranty provisions apply, in particular the VGG (Austrian Consumer Warranty Act), insofar as it applies to the respective contract. The relevant statutory provisions apply additionally.
(2) Consumers are asked to report recognisable problems with perishable goods, such as damaged packaging or irregularities upon delivery, as quickly as possible, stating the order details and, if possible, with meaningful photos, ideally within 24 hours by email to support@maquibeef.at. This obligation does not establish any additional exclusion or complaint period and does not affect the statutory warranty rights of consumers.
(3) The type and order of the statutory warranty remedies for consumers are governed by the applicable statutory provisions.
(4) For businesses, the statutory warranty provisions as well as the inspection and notification obligations of § 377 UGB apply. Due to the nature of perishable goods, an immediate inspection in the ordinary course of business is required; defects found must be reported within a reasonable period.
(5) Product liability claims and other mandatory statutory claims remain unaffected.
10. Subscriptions and recurring deliveries
(1) Where MaquiBeef offers subscriptions, the product scope, delivery interval, price, minimum term – if any –, billing period and cancellation options are stated before conclusion of the contract.
(2) If no minimum term has been agreed, the subscription may be cancelled for future delivery periods in accordance with the conditions communicated at the conclusion of the contract. Deliveries already triggered or bindingly ordered remain unaffected, insofar as legally permissible.
(3) Options to pause or change depend on the respective subscription offer.
(4) Price changes in ongoing consumer contracts are only made on the basis of an effective contractual agreement or with the customer's consent. These GTC do not establish a general unilateral right to change prices.
For businesses, MaquiBeef is entitled to adjust the subscription price agreed for future delivery periods if, after conclusion of the contract, the costs relevant for price calculation increase or decrease, in particular purchasing, procurement, energy, transport, packaging or personnel costs as well as taxes, levies or other charges imposed by public authorities. The price adjustment must be reasonably proportionate to the change in costs and will be communicated to the business before it takes effect. The business is entitled to cancel the subscription before the price change takes effect, as of the end of the current delivery period.
11. Vouchers and promotional codes
(1) Vouchers are subject to the conditions communicated at the time of purchase, in particular any redemption period stated there, as well as the statutory provisions. A shortening of the statutory limitation period only applies insofar as it has been validly agreed in the respective case and is legally permissible. Mandatory statutory rights of the customer remain unaffected.
(2) Promotional codes are valid within the stated promotional period and in accordance with the respective conditions. Cash payment of promotional discounts is excluded unless expressly agreed otherwise.
12. Data protection
Personal data are processed in accordance with the General Data Protection Regulation (GDPR), the Austrian Data Protection Act (DSG) and other applicable data protection regulations. Details on the processing of personal data in the shop, in particular in connection with payment processing, hosting, logistics and other service providers used, as well as on the rights of data subjects, can be found in the separate privacy policy at www.maquibeef.at/datenschutz.
13. Liability
(1) MaquiBeef is liable without limitation for damages resulting from injury to life, body or health and for intentionally caused damages.
(2) For consumers, liability for property damage and financial loss caused by slight negligence is excluded insofar as legally permissible. Mandatory statutory claims, in particular in the event of a breach of essential contractual obligations, remain unaffected.
(3) For businesses, liability for damages caused by slight negligence is excluded insofar as legally permissible. Otherwise, MaquiBeef is liable to businesses in accordance with the statutory provisions. Mandatory statutory liability, in particular for personal injury and under product liability law, remains unaffected.
(4) For damages resulting from delays in delivery, transport or inadequate cooling by commissioned logistics companies, the above limitations of liability apply insofar as legally permissible. Mandatory statutory claims remain unaffected.
14. Food information, allergens and storage
(1) The information legally required for the respective food is provided in the shop, on the packaging or in any other legally prescribed manner in accordance with the applicable food law provisions.
(2) The customer must in particular observe the storage, cooling, preparation, consumption and other safety instructions stated on the product.
(3) General recipe, grilling and preparation tips are for information purposes only and do not replace product-specific mandatory or safety information.
15. Special provisions for businesses (B2B)
(1) Special conditions may be agreed with businesses for bulk orders, event deliveries, special batches and other individually calculated orders.
(2) Down payments, payment terms, delivery dates, place of performance and procurement conditions may be set separately in the respective B2B offer.
(3) For disputes arising from contracts with businesses, the jurisdiction of the competent court at the registered office of MaquiBeef is agreed, insofar as legally permissible.
(4) Otherwise, the special provisions set out in these GTC apply to businesses.
16. Intellectual property
(1) Content of the shop and the associated channels, in particular texts, product descriptions, photos, videos, graphics, logos, trademarks and content of the Asado Academy, is protected in accordance with the applicable copyright, trademark and other intellectual property provisions. Insofar as MaquiBeef holds rights therein, these remain reserved.
(2) The reproduction, distribution, making available to the public, editing or commercial use of protected content is only permitted within the scope of statutory permissions or on the basis of a corresponding grant of rights of use.
(3) Third-party rights, in particular to trademarks, software, platforms and other content, remain unaffected; these GTC do not grant any rights of use therein.
(4) Confidential recipes, trade secrets and other unpublished information are not covered by any grant of rights of use under these GTC.
17. User-generated content and feedback
(1) If a customer posts their own photos, videos or other content in connection with MaquiBeef products on social media and tags them by using the hashtag #MaquiBeefShare and/or by tagging or linking the profile @maquibeef, they thereby express their general interest in use by MaquiBeef. This alone does not grant MaquiBeef a right of use or consent to the processing of personal data.
(2) If MaquiBeef wishes to use such content or other content published by the customer for its own marketing or communication purposes, MaquiBeef will contact the customer separately, in particular by direct message on the respective platform, and ask for express consent to this specific use (e.g. “May we use your post for our website/social media?”). MaquiBeef documents the request and the consent given in a suitable form, for example by keeping the message or a screenshot.
(3) Only with this documented consent does the customer grant MaquiBeef a simple, free right of use of the respective content for the purposes and types of use stated in the request, including the necessary technical adaptation, in particular of format, size and cropping. The right of use is unlimited in territory and applies until revoked in accordance with paragraph (5).
(4) Insofar as the content contains personal data, in particular images of persons, it is processed by MaquiBeef on the basis of the consent documented in accordance with paragraph (2) pursuant to Art. 6 (1) (a) GDPR. The customer may revoke this consent at any time pursuant to Art. 7 (3) GDPR; the lawfulness of processing carried out until revocation remains unaffected. Further information can be found in the privacy policy (see section 12).
(5) The customer may revoke consent at any time with effect for the future by informing MaquiBeef informally, for example by email to support@maquibeef.at or by message on the respective platform. After revocation, MaquiBeef will stop further use of the content within a reasonable period, insofar as technically and organisationally possible. Distribution that has already taken place and can no longer be reversed, in particular by third parties on platforms outside the control of MaquiBeef, remains unaffected.
(6) By giving consent in accordance with paragraph (2), the customer confirms that they hold the rights necessary to grant these rights and that the agreed use does not infringe any third-party rights, in particular copyrights and personal rights (§ 78 UrhG) of persons depicted. If other persons are recognisably depicted in the content, the customer must ensure that their necessary consent has also been obtained.
(7) The mere use of the hashtag #MaquiBeefShare, tagging or linking @maquibeef or using other hashtags does not in itself establish a right of use or consent to the processing of personal data. Further rights of use may be agreed separately in individual cases.
18. Errors and price information
(1) Despite careful maintenance, technical, editorial or other errors may occur in the shop, in particular in product descriptions, prices, availability or shipping costs. MaquiBeef is entitled to correct such errors. As long as no contract has been concluded, MaquiBeef may reject an order based on an obvious error.
(2) If a contract has already been concluded, the consequences of a price, declaration or other error are governed by the statutory provisions. These GTC do not establish a right to unilaterally change or cancel contracts already concluded.
(3) In the event of rejection of an order or effective cancellation of the contract due to such an error, MaquiBeef will inform the customer and refund payments already made without delay, unless there is a legal reason to retain them.
19. Technical operation of the shop
The use of an e-commerce, hosting or other technical platform does not change the fact that MaquiBeef is the customer's contractual partner for the goods sold via MaquiBeef. Information about service providers relevant under data protection law is provided in the privacy policy.
20. Out-of-court dispute resolution
(1) Unless there is a legal obligation, MaquiBeef is not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.
(2) Mandatory statutory information obligations and the possibility of voluntary participation in out-of-court dispute resolution proceedings in individual cases remain unaffected.
21. Final provisions
(1) Austrian law applies. For businesses, the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded insofar as legally permissible.
(2) For consumers, the choice of law only applies insofar as it does not deprive them of the protection of mandatory provisions of the law that would apply without the choice of law.
(3) For consumers, the mandatory statutory provisions on jurisdiction apply. For businesses, section 15 (3) applies additionally.
(4) Should a provision of these GTC be or become invalid, the remaining provisions remain unaffected to the extent permitted by law; the invalid provision is replaced by the statutory provisions.
(5) The version of these GTC effectively incorporated at the time of conclusion of the contract applies to the respective contract. Changes to published GTC do not automatically affect contracts already concluded or ongoing subscriptions.
